Section Background

The Legal Section is one of the Sections established under the administration of Kuantan City Council and is responsible for advising the Council and internal departments on legal matters as well as prosecuting Council suit cases as well as playing a role in ensuring the effectiveness of enforcement actions through By-Laws modification.

Section Objectives

  1. To create a community that truly knows, understands, abides by and appreciates the Laws of the Council.
  2. To advise the Council in ensuring that decisions are taken in accordance with the applicable Law.
  3. Ensure that the interests of the Council are always protected in every agreement transaction with the second party.
  4. Provide adequate reading materials and references to the Law for the use of the Council.
  5. Ensure that all actions of the Council are not 'ultre vires' by any Law.
  6. To ensure that the By-Laws adopted by the Council are constantly reviewed and renewed through enactment to meet current needs.

Section Functions

  1. Enforce the law through prosecution in court against all offenses under the Laws enforced by the Council.
  2. Provide legal advice to the Council.
  3. Prepare and review agreement documents for Council transactions with second parties.
  4. Enact and amend By-Laws, rules, orders and rules.
  5. Provide adequate reference materials of Laws and regulations for the use of the Council.
  6. Coordinate actions in civil claim cases.

Main Activities Implemented

  1. Preparation of agreement and review of agreement / rental documents.
  2. Revision, amendment, enactment and gazetting of Laws.
  3. Review of investigation papers (IP).
  4. Preparation of MBK staff authority card.
  5. Coordinate actions with lawyers in civil claims in Court.
  6. Conduct prosecution proceedings in Court.
  7. Implementation of arrest warrant operations with the Royal Malaysian Police.
  8. Provide legal views to the internal departments of the Council.
  9. Review the enforcement action taken to ensure that it is not “ultre vires ” to the law.
